Groupe Beneteau's business is to support all its customers in their boating projects and help make them come true. In this context, Groupe Beneteau is a leader in manufacture and distribution of recreational boats ("Boats”), parts and services associated with Boats (maintenance, commercial warranty, connected services, etc.), in particular those of the BENETEAU, JEANNEAU, PRESTIGE, LAGOON, EXCESS, DELPHIA, FOUR WINNS, WELLCRAFT and SCARAB brands (hereinafter collectively referred to as the “Brands”,  it being understood that where a specific Brand is concern, we refer to its name. 

This policy covers the processing of personal information of individuals (customers and prospective customers) who have, in the past, purchased, ordered or shown an interest in our products or services, as well as visitors of our Websites and services we offer through them (including personal online accounts as the case may be), the list of which is referred to in Section 10 below (the "Customer(s)", "you", "your"). Its purpose is to explain how we process your personal information and how you can control and manage it. Where appropriate, additional information may be provided when we collect your personal information. This policy also applies to you as a professional if you are the legal representative or authorized representative of a corporate customer.

 

1. WHO PROCESSES YOUR PERSONAL DATA?

Groupe Beneteau is an international group composed of several companies active in France and abroad, whose parent company is BENETEAU SA, having headquarters based in France. 

For the purposes of this privacy policy, "We", "Us" or "Our" refers to the Data Controller which centralizes the collection and processing of customers' personal information, all customer relationship management activities, the management of our Websites & services offered through them (e.g. boat configurator, customer service, events ...), as well as all personal information of Customers who have signed up to commercial initiatives and events of one or several Brands, and more specifically:  
 

  • AMERICAS: Beneteau Group America Inc, a company organized under the laws of the state of Delaware, with registered office located at 1535 SE 17th Street, Suite 205, Fort Lauderdale, FL 33316 (U.S.A.) 
  • OTHER GEOGRAPHIES: SPBI SA, registered with the commercial register of La Roche-sur-Yon under number 491 372 702, with registered office located Parc d'activités de l'Eraudière, 34 rue Eric Tabarly, 85170 Dompierre-sur-Yon (France)
     

(hereinafter individually the “Data Controller”).


Please note that we rely on independent networks to sell and maintain DELPHIA’ Boats, as well as, as the case may be, some products or services associated thereto ("the Network(s)"). Our Websites together with events or boat shows we attend offer you the opportunity to be put through them. 

This privacy policy is not intended to specifically cover your relationship with members of our Networks (including when you have come into contact with them through the services offered on our Websites or when participating in our trade shows or events) nor, where applicable, the services offered through other Groupe Beneteau companies or directly by them. In this case, these companies and the members of our Networks act as independent data controllers within the meaning of the applicable regulations on the protection of personal data.
 

2. What are your rights and how can you control the processing we carry out on your personal data?

You have rights that allow you to exercise control over your personal data. 2.1. You may request access to your personal data
 

If you wish to have access to your personal information, we will provide you with a copy of personal information to which your request relates as well as information relating to its processing.  
 

2.2. You may request the rectification of your personal data

If you consider that your personal information is inaccurate or incomplete, you may request that we amend or complete it. 
 

2.3. You may request the erasure of your personal data
 

If you wish, you can request the deletion of your personal data within the limits authorized by law.
 

2.4. You can object to the processing of your personal data based on legitimate interest
 

If you do not agree with processing based on legitimate interest, you may object to it, for reasons relating to your particular situation, by specifying the processing concerned and the reasons to us. We will no longer process your personal data unless there are compelling legitimate grounds for processing it or it is necessary for the establishment, exercise or defense of legal claims.
 

2.5. You can object to the processing of your personal data for commercial prospecting purposes

You have the right to object at any time to the processing of your personal data for commercial prospecting purposes, including profiling insofar as it is related to such prospecting.
 

2.6. You can suspend the use of your personal data

If you dispute the accuracy of the data we use or if you object to your data being processed, we will verify or examine your request. While your request is being examined, you can ask us to suspend the use of your data.
 

2.7. You can withdraw your consent
 

If you have given your consent to the processing of your personal data, you can withdraw this consent at any time.
 

2.8. You can request the portability of part of your personal data

You can request to receive a copy of the personal data you have provided to us in a structured, commonly used and machine-readable format. Where technically feasible, you can request that we transmit this copy to a third party.
 

2.9. How to lodge a complaint with the personal data protection authorities?

In addition to the above-mentioned rights, and if you are not satisfied with our response, you can lodge a complaint with the competent personal data protection authority, which is most often the authority of your place of residence, such as the Commission Nationale de l'Informatique et des Libertés (CNIL) in France.

 

3. Why do we use your personal data?

We provide you with explanations as to why we process your personal data and the legal bases on which we rely to justify it.
 

3.1. Your personal data is processed to comply with our various legal obligations
 

Your personal data is processed when necessary to enable us to comply with the laws and regulations to which we are subject. We use your personal data to:
 

  • Send you, where appropriate, an urgent safety notice or a reminder/recall of one of our products as part of service communications. These communications are necessary for us to meet our legal obligations.
     
  • To prevent, detect and manage legal and compliance risks or risks related to the company's reputation or corporate social responsibility (CSR) that we may face in the course of our activities.
  • To meet, where applicable, our obligations with regard to customs, the prevention of and fight against fraud and corruption, and compliance with international sanctions ( all economic or commercial sanctions including all laws, regulations, restrictive measures, embargoes or freezing of assets, decreed, governed, imposed or implemented by the French Republic, the European Union, the US Department of the Treasury's Office of Foreign Asset Control, and any competent authority in the territories where we are established)
  • Record, as necessary, transactions for accounting purposes
     
  • Comply, where applicable and as necessary, with the provisions of the eIDAS regulation relating to electronic signatures
  • Respond to an official request from a duly authorized local or foreign judicial, criminal, administrative, financial or tax authority, arbitrator or mediator, law enforcement authorities, government bodies or public agencies
     
  • To meet our obligations regarding the accessibility of our online services, as necessary
  • To respond to any request you make to us regarding the protection of your personal data (see the section “What are your rights?”), it being specified that this type of request may require verification of your identity.

3.2. Your personal data is processed to perform a contract to which you are a party or pre-contractual measures taken at your request.

Your personal data is processed when it is necessary for the conclusion or performance of a contract or pre-contractual measures in order to:
 

  • - Provide you with the products and services subscribed to in accordance with the applicable contract or those specified in your Boat's order form, in particular to ensure its manufacture, delivery and associated logistics.
     
  • To effectively manage the after-sales service and any warranty claims you may have, particularly with regard to your requests and questions relating to your Boat.
  • To carry out any internal or administrative operation, particularly in relation to the management of your contractual guarantees, and, where applicable, the management of the recovery of our debts and the response to any request for information that you send us in relation to your Boat.
     
  • To organize competitions and lotteries (for which the regulations specify the processing of personal data)

The processing of personal data necessary for the conclusion and execution of services associated with your Boat, such as, for example, your Seanapps Connected Services or certain other services, is specified in the confidentiality policy specific to these services, which we invite you to consult specifically.
 

3.3. Your personal data is processed to meet our legitimate interest or that of a third party, including yours or that of other entities of the Beneteau Group.

When personal data processing is based on legitimate interest, we ensure the right balance between this interest and your interests or your fundamental rights and freedoms.
As part of our activities, we use your personal data to:
 

  • To manage our consolidated prospect and customer database
  • To manage the risks to which we are exposed, for example the retention of proof of operations or transactions (including in electronic format), the management of your complaints and elements of our defense in the event of a dispute
  • To manage the organization and holding of events (open days, trials, boat shows, for example)
     
  • To respond to your requests and resolve any complaints, difficulties or problems related to our products and services
  • To respond to your requests for information related to our products and services and, where appropriate, to assist you in your efforts. This is particularly the case:
     
    • Via the sending of electronic messages: when you contact us (using the contact details available on our Websites) or send us messages to the contact email addresses provided on our Websites;
    • Via the Websites directly: intended for the general public, they are designed to inform you and help you better understand our products and services. We also offer online functionalities (in particular our forms) that use the information you provide when you ask to be kept informed, added to mailing lists, participate in events or experiences, book or request services (such as a trial or boat configuration), or be put in touch with members of our networks.
       
  • To conduct and manage our satisfaction surveys as well as to carry out any actions, in particular internal research and development, in order to improve the satisfaction of our customers as well as our products and services or to measure our brand image, it being specified that the choice to participate in a survey is entirely up to you. We may share this information with our Network, with your consent if necessary.
     
  • To improve your customer experience on the Websites as well as your overall experience, in particular your online browsing experience (screen size, pre-filling of certain fields, personalized online experience, etc.) and to support your use of the personalized pages of our Websites (including the processing of your access to and use of your user account and your single sign-on processes).
     
  • To manage, where applicable, your user accounts and means of authentication to your personal areas on our Websites.
     
  • To ensure the security and improve the management and maintenance of our Websites and the services offered on them, as well as to assist you in their use.
  • To improve the (cyber)security of our information and networks with the aim of taking measures to protect your personal data against loss or damage, theft or unauthorized access.

As a Groupe Beneteau company and unless you object:
 

  • We would like to offer you access to all of our Group's products and services that are similar to those you have purchased or subscribed to, and as such send you marketing and promotional offers by electronic means (email, SMS, social and digital media, third-party platforms, etc.). In this respect, and to ensure a fair balance between our respective interests, we always ensure that these commercial offers relate to products or services that meet your needs and complement those you already have.
  • We may also send you offers relating to our products, services and events, as well as those of the Beneteau Group, our networks and trusted partners, by telephone or post.
    We analyze your personal data in order to personalize our offers but also so as not to send you communications if we understand that they will not correspond to your interests.
  • In order to improve your experience and your satisfaction and to personalize our services and offers, we need to determine which customer panel you belong to. To do this, we establish a standard profile (without automated decision-making) based on the relevant data that we select from the information:
    • that you have communicated to us directly during your interactions with us or that you have provided during the acquisition or subscription of a product or service;
    • that comes from your use of our various channels such as our Websites, the events or trade shows in which you participate.
       

If you are a professional customer, we may send you commercial offers related to your professional activity unless you object.
 

3.4. Your personal data is processed if you have consented to it

For certain processing of personal data, we ask for your prior consent and provide you with specific information. We remind you that you can withdraw your consent at any time. We ask for your consent in particular for:
 

  • Sending you any marketing or promotional offers by electronic means (email and/or SMS) or any advertising campaigns (digital or otherwise, including the sending of newsletters) relating to products and services that are not similar to those that you own or have subscribed to, or products and services from our Networks and trusted partners
     
  • Sharing, where applicable, your Personal Data with a professional from our Networks (you are asked for consent directly on our forms)
  • Using your browsing data (cookies or any technologies) for commercial purposes or to enrich the knowledge of your profile (online advertising targeting, personalization of content). In this regard, we invite you to refer to section 9 “Cookies” of this policy.
     

Other consents to the processing of your personal data may be requested from you when necessary.
 

4. What personal data do we process?

“Personal data” means any information that identifies you directly (such as your name) or allows us to identify you indirectly (for example, using a unique identifier). 
In all cases, we undertake to collect only personal data that is relevant and appropriate for each of the purposes for which we process it. We invite you to keep us regularly informed in writing of any changes concerning your personal data.
In all our forms (including those related to the creation of your personal spaces, if applicable), the data that is essential to respond to your requests or for the purposes of a contract or a legal obligation is marked with asterisks. If you do not wish to provide the mandatory data, it will probably be impossible for us to process your request or provide you with the relevant services. Other information is intended to help us get to know you better, in particular to send you personalized messages. This information is, therefore, optional.
The personal data we collect depends on our interaction with you and may include information regarding:
 

  • Contact details (private or professional) and identification data: for example, full name, gender, place and date of birth, postal address, e-mail address, telephone number, photo, signature, customer number;
     
  • Data related to your personal and/or professional situation: family situation, socio-professional category, etc.
  • Data related to your lifestyle: hobbies and interests, browsing zone or preferences.
  • Economic, financial and tax information: for example, tax status, country of residence.
     
  • Data relating to our commercial relationship, in particular our interactions and contracts (order history, after-sales interventions, service contracts, competitions, interactions with our customer service or, where applicable, our after-sales services, etc.),
  • Information related to the products and services you hold, for example data identifying your Boat (model, WIN no., options, etc.).
     
  • Data collected in the course of your interactions with us: your comments, suggestions and requirements collected during our exchanges with you in person at boat shows and/or events (comments) or satisfaction surveys (your experience of our products and services) and online during email exchanges and your latest complaints/claims including your requests regarding personal data protection and privacy;
     
  • Data necessary for the implementation of loyalty-building, prospecting, study and survey actions (e.g. your preferences in terms of Boats),
     
  • Data concerning the use of our Website, online services and pages on social networks, as well as our communications (actions on our Websites such as click behavior, number of visits, page visited, opening of our communication messages, connection and tracking data such as cookies and tracers for non-advertising or analytical purposes).
     
  • Data concerning your digital profiles: for example, your user account profile data, login details, authentication data to help us establish your identity when accessing your personal space on our Websites, connection data (logs) or personalized security features used to connect you to your personal online spaces,
     
  • Data concerning your electronic devices (mobile phone, computer, tablet, etc.): IP address, technical characteristics and unique identification data, type of hardware, domain, browser type and language, operating system and settings, time and time zone.
     

The products and services we offer are intended for adults. We therefore do not carry out any specific processing of data relating to minors or children. 

 

5. From whom do we collect your personal data?

We may collect your personal data directly from you from the sources indicated above in Article 4 or indirectly from:
 

  • The professionals in our Networks: all the data you provide to them is controlled by them. If you have any questions regarding the use of your personal data, we recommend that you contact them directly.
     
  • Other trusted partners (including other Groupe Beneteau companies) and our technical service providers and suppliers: to guarantee the performance of our services, particularly our online services, and to enable us to retain relevant data and process current requests or improve and provide our products and services, we may receive data about you or your activities from third-party suppliers or service providers.

     

6. With whom do we share your personal data and why?


Within the Beneteau Group, only persons duly authorized by virtue of their functions and duties are authorized to process your personal data.
We may share your personal data with:
 

6.1. Other Beneteau Group companies
 

As a member of the Beneteau Group, we work closely with other Beneteau Group companies in France and abroad. Your personal data may therefore be shared between Beneteau Group entities, when necessary in order to:
 

  • Comply with the various legal and regulatory obligations described above
  • Fulfill your orders for products and services and your warranties
  • Satisfy our legitimate interests and as such:
     
    • Improve the accuracy and reliability of data concerning you that may be held by other Bénéteau Group companies
    • Conduct studies, particularly statistical, for commercial, security, compliance and risk management purposes
    • Offer you access to all the Beneteau Group products and services best suited to your needs and desires
    • Personalize the products and services we provide to you
       
    • Conduct activities, including internal research and development, aimed at improving our Boats and services as well as at gaining knowledge of and satisfying our customers (unless your consent is not specifically required, in which case we will specifically ask for it)
       
    • Pooling of resources within the Beneteau Group, in particular for the purposes of maintenance and support for services and systems, global analytics, and commercial, IT and administrative continuity.
       

Your personal data may also be passed on, as necessary, to the teams of Groupe Beneteau companies in charge of preventing the risk of fraud and non-payment, to the accounting teams or to the teams in charge of compliance checks, of processing alerts sent to us or requests you make to us relating to personal data protection.
 

6.2. Companies outside Groupe Beneteau: recipients or subcontractors


6.2.1. Recipients

We may share some of your personal data with independent partners who will use it for their own purposes. In such cases, these partners act as independent data controllers and their personal data processing policy applies to the personal data thus shared. 
We will inform you in all circumstances and we will make sure to ask for your consent to this sharing when required by regulation, or at least to allow you to object. 
More specifically, we may share personal data with:
 

  • Our Networks: in the event that you have requested a service that they provide (for example, a request for a test near you, a request to participate in an event they organize), if you have needed their assistance or that provided by us and more generally to satisfy your requests for products and services, for the needs of the evaluation and training of our Networks and to be able to improve your experience as a Customer and the quality of the services you receive when you interact with our Networks. We will ask for your consent where necessary.
  • Public authorities: the police or other public authorities and bodies (local or foreign tax, administrative, stock exchange, criminal or judicial authorities, arbitrators or mediators) may at any time request personal data concerning you, for example for the prevention or detection of crime or the arrest or prosecution of criminals. We may also share personal data with them as part of our defense, an action or a procedure, or to comply with our legal and regulatory obligations.
  • Investors, professional advisors and regulated professions: these include, for example, our insurers, lawyers, bailiffs or auditors when specific circumstances require it (audits, disputes, internal restructuring, competitions, etc.) or third-party investors or buyers and their professional advisers (lawyers, accountants) in the event of future sales or investment transactions involving us or the Bénéteau Group
     

6.2.2. Subcontractors

We may share your personal data with third-party suppliers and service providers acting as subcontractors according to our instructions and on our behalf only, in particular for:
 

  • The hosting, operation or maintenance of our databases and Websites.
     
  • The provision of certain services in connection with our commercial relations or your Customer experience (conducting studies, surveys and polls, etc.)
  • The provision of support services relating to our marketing and advertising (including digital), including the sending of commercial offers and the management of advertising campaigns
  • The provision of services related to the organization and logistics of competitions, events or boat shows
     
  • For all these data sharing operations, we take care to work only with trusted companies and to secure these relationships, in particular by means of contracts, audits, guarantees and security measures.
     

7. How are the security and international transfer of your personal data ensured?
 

Your personal data is stored on secure servers. We implement, and require our subcontractors and partners to implement, appropriate and reasonably necessary security and data confidentiality protection measures, in line with the latest technologies.
As part of the creation of a personal space, entering a password that meets our security standards is mandatory and part of this Policy. It is your responsibility to keep it secret and we ask you not to share your password, username or any other form of authentication with anyone. Furthermore, you undertake to inform us of any unauthorized use of your user account, username and password. You are also advised to make sure you log out at the end of each session. We cannot be held responsible for any unauthorized use of your user account, username and password and for any actions that may be carried out on this user account, or for any loss or damage that may occur in the event of a breach of these obligations.
As far as possible, your data is processed in the European Economic Area (“EEA”). However, as some Bénéteau Group entities, some of our service providers or their subcontractors/parent companies are located in countries outside the EEA, your personal data may be processed in those countries.
In the case of international transfers from the EEA to a non-EEA country, the transfer of your personal data may take place on the basis of a decision issued by the European Commission, when the latter has recognized that the country to which your data will be transferred ensures an adequate level of protection.
In the event of transfer of your data to a country whose level of data protection has not been recognized as adequate by the European Commission, we will either rely on a derogation applicable to the specific situation or take measures to ensure the protection, security and confidentiality of your personal data, in particular by implementing the standard contractual clauses approved by the European Commission.
Upon request to the address mentioned in the section “What are your rights”, we can provide you with more information about these security measures and international transfers.
 

8. How long do we keep your personal data?
 

We will retain your personal data for the period of time strictly necessary to achieve the objective we are pursuing, to meet your needs or comply with our legal and regulatory obligations, to resolve disputes and enforce our rights, taking into account our legitimate interests.
In order to determine this period of time, we take into account the following elements in particular:
 

  • The duration and stipulations of your contracts, in particular the contractual warranty of your Boat
     
  • The time needed to process your request or your claim/complaint
  • Your interest in our Brands,
  • The duration for which your user account is open and active
  • The need to keep a certain history of your interactions with us, for the proper management of our business relationship and your Customer experience, this duration varying in particular depending on whether you have purchased a boat, a service or only interacted with us without entering into any contracts
  • Our legal or regulatory obligations.

     

We also take the following factors into account: the categories of personal data processed, the recommendations of the competent authorities regarding personal data protection, the legal limitation periods, the applicable legal or regulatory requirements and industry standards.
When we no longer need to use your personal data, it is deleted from our systems and records or rendered anonymous so that you can no longer be identified. However, we may retain some of your personal data on file in order to be able to respond to any legal action, for the duration of the limitation period provided for by the applicable legislation.

 

9. How do we specifically handle cookies and other technologies placed on our websites and in our communications?

In this section, we explain how we place, use and store cookies and tags on your devices when you visit our websites. By device, we mean any computer, smartphone, tablet or any other device you use to access the internet.
 

9.1 What is a cookie?

A cookie is a small text, image or software file that can be stored and/or read on your device when you access our Websites. They can be session cookies, in which case they are deleted from your device once the session and browser are closed, or persistent cookies, in which case they are stored on your device until they are deleted. For the sake of simplicity, we will use the term “cookies” in the rest of this section to refer to all of these technologies.

9.2 What type of information can be stored in a cookie?
 

Within the limits of their retention period, the information stored by cookies may relate to the following: the web pages you have visited, the advertisements and communications you have clicked on, your IP address, the type of browser you use and any other information you have provided on our Websites. They may contain personal data covered by the other sections of this privacy policy.
 

9.3 What types of cookies do we use and why?

We use different categories of cookies, which are detailed below.
a) Strictly necessary (mandatory) cookies and audience measurement cookies exempt from consent 
Mandatory cookies are essential for the functioning of our Websites. They may include, for example, cookies that allow us to personalize the interface of our Websites (such as the choice of language) or to comply with our obligations in order to ensure a safe online environment for you.
b) Functionality cookies (subject to your consent)
These cookies enable us and our partners to personalize and offer the content and functionality of our Websites and in particular the display of our products and services pages. They are used to improve our Websites and your user experience. If you do not accept these cookies, some or all of the associated services may not function properly.
c) Audience measurement cookies subject to consent 
These cookies enable us and our partners to understand how you arrive at our Websites, to measure the number of visitors, but also to analyze the way in which you browse our Websites or to reconstruct your journey (number of pages viewed, frequency of return, etc.).
These studies help us to improve the way in which our Websites operate by ensuring, for example, that you can easily find what you are looking for.
d) Advertising cookies (subject to your consent)
There are different categories of cookies that allow us to offer you advertising. The information obtained through advertising cookies is frequently shared with our partners through the use of third-party cookies.

    These cookies are used to offer you personalized advertisements on our Websites or on third-party sites. They record your visit to our Websites, the pages you have visited and the links you have followed. 
    They can also be used to display personalized advertisements for our products or services on other websites, to measure the effectiveness of an advertising campaign, to limit the number of times you see an advertisement, for advertising affiliation purposes, for click fraud detection, market research, product & service improvement or debugging.
  • Non-personalized advertising cookies:
    These cookies enable us and our partners to display advertisements that are not personalized to your interests. These cookies can be used to measure the performance of a marketing campaign.
  • Geo-located advertising cookies:
    These cookies enable us and our partners to display personalized advertisements based on your location (geo-located advertisements).
     

e) Social network cookies (subject to your consent)
These cookies are activated by the social network services that we have added to the Websites to enable you to share our content with your network and acquaintances. They also enable us to track your browsing activity on other websites and to build up a profile of your interests. This may impact the content and messages displayed on other websites you visit. If you do not authorize these cookies, you may not be able to use or view these sharing tools.

9.4 Who places cookies on your devices and how long do they last?
 

Cookies and trackers may be placed by us or by third-party partners. The use of such partners allows us to benefit from the technical services they offer.
The list of partners concerned is available via the “Manage cookies” section (at the bottom of all the pages of our website) by clicking on “associated partners” under each cookie category.
We may share data such as your hashed email address or any other technical identifier with our advertising partners in order to establish a link between your various connection devices or internet browsers and offer you a consistent and continuous experience on them.
In some cases, our third-party partners may use the information in question for their own purposes and are thus responsible for the processing they carry out. This data processing is sometimes carried out outside the EEA, in a “third country” where the rules applicable to the processing of personal data are different from those in force within the European Union.
